Terms of Service & Legal Notice

By visiting our site and/or purchasing products from Xyva Tech, you engage in our "Service" and agree to be bound by the following terms and conditions, including all additional policies referenced herein.

1. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by, interpreted, and construed in accordance with the laws of the State of Western Australia (WA), Australia, and the Commonwealth of Australia, without regard to conflict of law principles.

2. Accuracy of Site Information & Trademark Notice

We endeavor to present accurate product descriptions, VESA dimensional templates, maximum weight capacities, and pricing. Independent Workstation Hardware Brand Notice: Xyva Tech is an independent ergonomic workstation accessories retailer and brand. Xyva Tech is not affiliated with, sponsored by, or endorsed by Ergotron, Fully, Grovemade, Humanscale, Dell, or Apple. Any comparative references are made strictly for functional specification, VESA mounting standard compliance (e.g., 75x75mm / 100x100mm), and hardware dimension context. Xyva Tech reserves the right to correct any inadvertent inaccuracies at any time without prior notice.

3. Mechanical Weight Ratings, Desktop Material Safety & Gas Spring Notice

Safe Working Load & Desk Material Warning: Monitor arms and desk clamp mounts are engineered strictly for desktops constructed from solid hardwood, dense MDF, or structural plywood within published thickness parameters (typically 10mm to 85mm). Never install heavy clamp mounts onto hollow-core honeycomb paperboard desks (such as paper-filled particle boards) or glass-top desks without specialized reinforcement plates, as clamp torque can puncture desktop skins. Never exceed maximum screen weight ratings (e.g., 9kg per arm for standard models, 16kg for ultrawide models). Pneumatic Gas-Spring Tension: Adjust arm counterbalance tension screws carefully using provided Allen keys only while the monitor display is safely mounted. Xyva Tech is not liable for display drops, fractured desktop surfaces, or property damage resulting from overloading, hollow-desk clamping, or improper counterweight tension calibration.
